2 Typically, when Congress enacts a new standard, states which set their own standards (noted in green) can continue to enforce their standards until a federal standard for that product takes effect, at which point the state standard is null (noted in black). In some cases, states have set standards stronger than existing federal requirements for that product (states in green, italics) and are seeking waivers from federal preemption to enforce them.
