In the 1980s, multiple states adopted standards setting maximum water use levels for showerheads, faucet aerators, toilets and urinals. Based on these standards, Congress adopted national standards on these products in the Energy Policy Act of 1992. The standards took effect in 1994. Under the law, the American National Standards Institute is supposed to revise these standards, with DOE reviewing ANSI’s action. If ANSI does not revise the standards within five years, states are free to set their own standards. To date, ANSI has not revised any of these standards. In September 2007, the California legislature adopted legislation setting new toilet and urinal standards that are 20% lower than the federal standards.
